“store” refers to our physical shop located at Rotorua Florist,1222 Eruera Street, Rotorua, 3010, New Zealand.

“gift” refers to any additional non-floral items (excluding cards) that can be bought on our website.

“Stripe” refers to the payment processor, Stripe New Zealand Ltd, NZBN: 9429041687628.

“our website” refers to domain names (rotoruaflorist.co.nz and rotoruaflorist.com) and their associated hosted websites served on those domain names.

The words “you”, “user” or “your” means you, the user of our services / website or purchaser of our goods.

By accessing the website (rotoruaflorists.co.nz) or buying any products listed on this website, you are agreeing to be bound by these Terms of Service.

Prices

All prices are in New Zealand Dollars (NZD) and include applicable GST (15%). Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the service.

Furthermore, we accept no responsibility for any loss suffered in connection with the use of this website, or for any loss or damage to goods occurring in transit or otherwise howsoever beyond the cost paid for those goods.

Substitution

We reserve the right to substitute a product of equivalent value where a listed product is unavailable. When making substitutions we do not call the sender as this could delay the order from being delivered on the requested date.

 Seasonal conditions may affect the supply of flowers and specific varieties or colours may not always be available or meet our quality standards. In some cases, substitutions may be necessary to fulfill your floral arrangement. Where possible, the particular container or basket shown will be supplied. Should these not be available, alternative containers of a similar value and style will be substituted at our discretion.

Cancellations / Refunds

If you choose to cancel your order once it has been placed we are more than happy to offer a full refund back to your credit card. We are unable to offer a refund on the day of dispatch as the flowers and gifts will already be on the way; (this applies to all orders, placed via the website). Floral gifts are perishable and cannot be exchanged or refunded.

Deliveries

In the highly unlikely event that your flowers are not received, please contact us as soon as possible so we investigate your order. Non-delivery queries must be lodged with us within 48 hours. If you have given us a wrong address we are more than willing to re-deliver your order providing you pay for an additional delivery charge. However, we are not responsible for deliveries if the recipient is not at the location at the time of delivery. If you are the customer, you must make sure that the recipient will be at the location on the date provided on the order for delivery.

 To avoid delays with your order, if you select the incorrect delivery charge when using our checkout, we reserve the right to charge your account the additional amount without confirmation.

Security

Our website uses industry standard technology such as TLS encryption (indicated by lock icon in your browser) in order to make your browsing secure from unauthorised third parties. All credit card information is handled by our payment provider Stripe and does not touch our infrastructure. Unfortunately, no data transmission over the internet can be guaranteed as totally secure. Accordingly, although we strive to protect such information, we cannot ensure or warrant the security of any information you transmit to us or from our online products or services and you do so at your own risk. Once we receive your transmission, we take all reasonable steps to preserve the security of the information in our own systems.

Returns Policy

We are committed to providing quality products to our customers. If for any reason you are not completely satisfied with your non-floral gift, it may be exchanged for another gift to the same value. Higher value gifts may be substituted with payment of the difference.

 Return of the unwanted gift(s) back to our store must occur within seven days of purchase. Returned goods must be unused and in resalable condition and be accompanied with an explanation for your return.

Modifications

We may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

Your privacy is important to us. It is our policy to respect your privacy regarding any information we may collect from you across our website, and other sites we own and operate. We only ask for personal information when we truly need it to provide a service to you. We collect it by fair and lawful means, with your knowledge and consent. We also let you know why we are collecting it and how it will be used.

 When you place an order we will ask you to provide certain information about yourself, such as your name, or e-mail address. The personal information you submit when placing your order is treated as confidential. We use this information to process your order, payment information is handled by the payment provider Stripe.

These Terms of Service and any separate agreements where we provide you with these services shall be governed by and construed in accordance with the laws and courts of New Zealand.
